Résumé

Réponse à la question du contrôle de la fortune publique, le mythe de Damoclès, lié au dispositif juridique de la responsabilité personnelle et pécuniaire (RPP) du comptable public, a pour objet véritable, quoiqu’indirect, d’écarter de l’opinion toute suspicion de malversation. Ce faisant il suscite un imaginaire, fruit des interactions entre mythe et droit public financier. Celles-ci sont analysées à partir de témoignages des années 1950, alors qu’échoue une réforme juridique de cette responsabilité.

Abstract

The solution to the issue of controlling the public purse, the myth of Damocles in relation with the public accountant's legal system of personal and financial liability, is to put to rest the public's opinion any suspicion of malfeasance. In doing so, it arouses a fantasy, the fruit of the interactions between the myth and public finances law. These are analyzed from testimonies from the fifties, when a legal reform of this responsibility failed.
